Terms of Service

These Terms of Service (hereinafter referred to as “these Terms”) define the conditions for using Halo EYEQ (hereinafter referred to as “the Service”). All users of the Service (hereinafter referred to as “Users”) must agree to these Terms.

Article 1 (Application)

These Terms shall apply to all relationships between Users and the Company regarding the use of the Service.

Article 2 (User Registration)

Those who wish to use the Service must apply for user registration according to the method specified by the Company after agreeing to these Terms, and user registration shall be completed when the Company approves the application.

Article 3 (Prohibited Actions)

When using the Service, Users shall not engage in the following actions:

  1. Actions that violate laws or public order and morals
  2. Actions related to criminal activities
  3. Actions that destroy or interfere with the functionality of the Company’s servers or networks
  4. Actions that may interfere with the operation of the Company’s Service
  5. Actions that collect or accumulate personal information about other Users
  6. Actions that impersonate other Users
  7. Actions that directly or indirectly provide benefits to antisocial forces in connection with the Company’s Service
  8. Other actions that the Company deems inappropriate

Article 4 (Suspension of Service Provision, etc.)

The Company may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following reasons apply:

  1. When performing maintenance, inspection, or updates of the computer system for the Service
  2. When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
  3. When computers or communication lines, etc. stop due to accidents
  4. When the Company determines that it is difficult to provide the Service for other reasons

The Company shall not be liable for any disadvantages or damages suffered by Users or third parties due to the suspension or interruption of the Service, regardless of the reason.

Article 5 (Usage Restrictions and Registration Deletion)

If a User falls under any of the following cases, the Company may, without prior notice, restrict all or part of the User’s use of the Service, or delete the User’s registration (account suspension):

  1. When violating any provisions of these Terms
  2. When it is found that there is false information in the registered information
  3. When the Company determines that use of the Service is inappropriate for other reasons

The Company shall not be liable for any damages suffered by Users due to actions taken by the Company based on this Article.

Article 6 (Disclaimer)

The Company’s liability for non-performance of obligations shall be exempted if it is not due to the Company’s willful misconduct or gross negligence.

Article 7 (Changes to Service Content, etc.)

The Company may change the content of the Service or discontinue provision of the Service without notice to Users, and shall not be liable for any damages suffered by Users as a result.

Article 8 (Changes to Terms of Service)

The Company may change these Terms at any time without notice to Users if it deems it necessary.

Article 9 (Governing Law and Jurisdiction)

These Terms shall be governed by Japanese law. In the event of any dispute regarding the Service, the court having jurisdiction over the location of the Company’s head office shall have exclusive agreed jurisdiction.
